FTC Amazon Prime Lawsuit Settlement: How to Claim Your Refund

ftc amazon prime lawsuit settlement

Amazon has agreed to a $2.5 billion settlement with the Federal Trade Commission (FTC) over allegations that it tricked customers into signing up for Prime and made canceling the subscription difficult. Of that amount, $1 billion is a civil penalty and $1.5 billion is set aside for refunds to consumers.

Here’s what you need to know about eligibility and how to get your money back.

Who Qualifies for a Refund?

According to the FTC, tens of millions of Amazon customers were impacted. Refund eligibility depends on when and how you signed up for Prime.

  • Automatic Refunds (Up to $51)
    • Applies to customers who signed up for Prime between June 23, 2019, and June 23, 2026 through one of Amazon’s challenged enrollment flows, such as:
      • Single Page Checkout
      • Shipping Option Select Page
      • Prime Video sign-up screen
    • Customers must have used no more than three Prime benefits within any 12-month period.
    • Refunds will be sent automatically within 90 days of the settlement order.
  • Refunds by Claim (Up to $51)
    • Applies to customers who either:
      • Signed up through a challenged enrollment flow, or
      • Tried to cancel Prime but couldn’t.
    • These customers must have used no more than 10 Prime benefits in a 12-month period.
    • A claim form will be sent out within 30 days after automatic refunds are issued.

How to Claim Your Amazon Prime Settlement Refund

If you are in the automatic refund group, you don’t need to do anything — your refund will be processed and paid by Amazon directly.

If you are in the claim group, here’s how it will work:

  1. Notification – Amazon must notify eligible customers within 30 days by email, postal mail, or through a notice on its website and app.
  2. Claim Form – You’ll receive a form asking if you were unintentionally enrolled or tried to cancel without success.
  3. Submission – You’ll have 180 days to submit the form using:
    • The official settlement website,
    • Email, or
    • Prepaid First-Class mail.
  4. Review – Amazon will review your claim within 30 days and determine if you qualify.
  5. Payment – If approved, you’ll receive a refund equal to the Prime membership fees you paid, capped at $51.

What Changes Are Coming to Amazon Prime?

The settlement requires Amazon to change how Prime is presented to customers:

  • A clear “Decline Prime” button instead of misleading “No, I don’t want free shipping.”
  • Upfront disclosure of costs, billing dates, auto-renewal, and cancellation rules.
  • A cancellation process that is just as simple as signing up.
  • Oversight by an independent supervisor to make sure refunds are distributed properly.

Key Points to Remember

  • Refund Amount: Up to $51 per customer.
  • Refund Timeline: Automatic payouts within 90 days; claims processed within 180 days.
  • Eligibility: Prime sign-ups between 2019–2026 through deceptive flows or failed cancellation attempts.
  • Process: Automatic for some; others must submit a claim form.

The FTC Amazon Prime lawsuit settlement is one of the largest consumer refund payouts in history, giving millions of customers the chance to recover money lost to unwanted Prime subscriptions.
