Evolve Bank & Trust agreed to pay $11.85 million to resolve a class action lawsuit after cybercriminals gained unauthorized access to its information systems. The breach exposed sensitive personal information, including:
- Names and birth dates
- Social Security numbers
- Driver’s license numbers
- Bank account information
- Contact details
The breach affected both personal banking customers of Evolve Bank & Trust and customers of financial technology partners (“Evolve FinTechs”), such as Affirm, Dave, Mercury, and others, who received banking services through Evolve via Synapse Financial Technologies.
Why the Settlement Happened
The class action lawsuit was filed due to unauthorized access to Evolve Bank & Trust systems that compromised sensitive customer data. While Evolve Bank & Trust denies wrongdoing, it agreed to settle to avoid lengthy litigation and potential trial costs

You can file a claim if you meet all of the following criteria:
- You reside in the United States.
- You provided personal information to Evolve Bank & Trust directly or indirectly through a financial technology partner.
- You were a personal banking customer of Evolve or a customer of an Evolve FinTech partner.
- Your personal information was included in the files compromised during the February or May 2026 breaches.
How Much Can You Claim?
Class members can select from the following options:
1. Cash Payment A – Documented Losses:
- Up to $3,000 for losses directly related to the breach.
- Requires proof, such as receipts, invoices, or official records showing financial impact.
2. Cash Payment B – Flat Cash Payment:
- A pro-rata cash payment estimated at $20.
- Available to those who file a Documented Losses claim.
3. Credit Monitoring Services:
- One year of free credit monitoring valued at $100, including real-time alerts and identity theft insurance up to $1,000,000.
